TSCA User Fees Proposal

What's Happening?

The Environmental Protection Agency (EPA) released a prepublication version of the proposed rule to increase the fees associated with Section 5 submissions.  The fee for the submission of a Premanufacture Notice (PMN) is going to be increased from $2500 to $16,000 and the fee for the submission of a Low Volume Exemption (LVE) will be increased from $0 to $4700.  

This notice provides details of the TSCA fees and fee categories that would begin in fiscal year 2019 (October 1, 2018 through September 30, 2019). The Agency will subsequently adjust fees, as necessary, every three years to reflect inflation and ensure that the receipts are sufficient to cover 25% of the costs to carry out the activities specified in TSCA section 26(b) as well as 50% or 100% of the costs of risk evaluations requested by manufacturers, depending on the chemical.

EPA has proposed to start collecting fees the day after the final TSCA user fees regulations are published in the Federal Register. The Agency sought comments on all aspects of the fee categories being proposed through April 27, 2018.  Additional information is available in the link provided below.
